Farzad Family Law Scholarship

At Farzad Family Law we strongly believe in education and giving back to the legal community. As lawyers we placed great value in our own education when we made sacrifices on our paths to and beyond law school. We want to help others who intend to do the same.

As strong advocates for higher learning, we are proud to give back to aspiring lawyers through the Farzad Family Law Scholarship.  This annual scholarship is awarded to one student based on merit.

The scholarship recipient will receive the scholarship award in approximately 30-60 days after the deadline. By participating, you are giving your consent for us to contact you via mail, email and/or call to you. In addition, if you are the winner, you are giving us your express consent to use your name, college or law school identification and your essay on this site and for any other promotional purposes, without further compensation or payment to you. If you want us to use your photo, please send that in with your submission. The scholarship recipient is responsible for payment of any applicable State and/or Federal income taxes due to the receipt of the scholarship.

2015 Eligibility Requirements

Scholarship Award: $3,500

Application Deadline: Must be received by December 15, 2015

This scholarship is available to all college students or law students who are currently admitted to and attending an undergraduate degree program at an accredited American university or college or are admitted to and attending a state accredited law school.

How to Apply

Please write an essay on the questions outlined below and provide us with proof of your current attendance at the college or university (for example, if you wish, by including your transcripts). Your response should be between 2,500 to 4,500 words, although the length is not strictly enforced.

You are required to include the following information in your application:

Your full name, address, and contact details including your phone number and email address.
A statement of your current academic status, as well as evidence that you are currently attending college or law school as set forth above. You may submit as evidence your most current undergraduate or law school transcript. You give us express consent to confirm your admission and attendance by contacting the college or university.

Your essay as a Word document, Pages (Mac) or PDF attachment. Essay’s in WordPerfect or any other form will not be accepted.

2015 Essay Question

The 2015 essay presents a challenging four part question:

1. Should a female victim of rape whose child was conceived through rape have the right to forever terminate the perpetrator’s parental rights in every respect? Assume for this question the perpetrator was criminally convicted of the rape.

2. Should a condition precedent of such a termination of parental rights be the criminal conviction of the alleged perpetrator for rape?

3. Should a condition precedent of such a termination of parental rights be that a non-biological parent (male or female) will also adopt the child (resulting in the child having two parents)?

4. Should the perpetrator of rape still be obligated to pay the victim child support throughout the child’s minority (which you can assume means under the age of 18) even if his parental rights are terminated?

Tips for the Essay

1. Research the subject. The laws vary from State to State and learning different State’s laws may help you understand the reasoning behind the differences. But do not assume you have to follow any State’s laws. This is your analysis, not a regurgitation of a set of laws that already exist.

2. Be original. Do not simply repeat what you have read others write. Do not plagiarize. It is grounds for immediate disqualification.

3. This is a sensitive topic and can give rise to heightened emotions (and justifiably so) but this essay will be judged on the quality of the writing and its persuasiveness. We will judge it objectively and without regard to a “right” or “wrong” position.

4. Put some focus on the child conceived and what is in his or her best interest. A focus only on punishment of the perpetrator or help for the victim may limit the legal analysis.

5. The second question is a difficult one. You have to consider that not every alleged perpetrator of rape is prosecuted or even convicted. What happens in such situations? Would a civil finding that the rape occurred by a lower standard / burden of proof be sufficient to terminate parental rights? Can that finding be in a family court? What would that standard / burden of proof be? A preponderance of the evidence? Higher?

6. On the third question, consider whether it makes a difference if the proposed adoptive parent is male versus female. This subject is also rich with an opportunity to write persuasively on a controversial subject.
